Bank attorney says homeowner's insurance suit settled; magistrate grants 120 days for demolition coordination

During the June 4 Charlotte County code hearing, attorney Shay DuPont, appearing for US Bank (lienholder) in the case involving 3364 Harbor Boulevard (COD23‑01739), reported that the homeowner's lawsuit against the insurance company for an inadequate payout had been settled. DuPont said the bank and homeowner "would like to have control of the demolition process" and requested time for the parties to complete the work.
Officer Paul Davis had previously presented photos and inspections showing damaged roof, windows and walls stemming from Hurricane Ian. The magistrate entered the third affidavit $70 but asked that the county not bring the matter back for enforcement while the bank and homeowner coordinate a demolition plan and requested 120 days for the work to occur.
The magistrate requested status updates through the assigned code compliance officer and said the case will be closed once demolition and permit activity are underway.
