Council tables Deer Park right-of-way vacation after neighbor objections

During a public hearing on vacating a perimeter right-of-way in the Deer Park plat, nearby residents expressed opposition and the applicant and staff agreed to continued discussion before final action.
Public Works Director Mr. Omi presented the request from the owner of 16535 Lagle Avenue to vacate unused right-of-way adjacent to his property. Staff said the right-of-way (part of an 1887 plat) contains no existing city streets or utilities and that the city has no current plans to install infrastructure there; staff also said they had worked with the property owner to dedicate roadway easements along Lagle Avenue where needed.
Resident Steven Buck (16530 Judicial Road) testified he opposes closing the east end of Vine Street because his front yard sits about 50 feet from that right-of-way, he has maintained the gravel road for 15 years and he fears future development would route traffic close to his home. Buck said vacating part of the right-of-way to benefit one property owner would be unfair to others.
Applicant Darren Schmidt (16535 Lagle Avenue) said the easement was never constructed, is too narrow and steep to be an effective 30-foot road, and that his request is tied to granting road easements to the city on Lagle Avenue so the traveled path can be formalized and maintained. Schmidt said he has worked on the proposal for about 10 months.
Councilors and staff discussed treating the area comprehensively rather than approving a single-parcel fix; staff said the item could be tabled for continued discussions. The council closed the public hearing and voted to table the vacation for further work with neighboring property owners and staff.
