Clayton council tightens snow‑emergency penalties, aligns hydrant rules, advances SR‑48 sidewalk work and extends care‑facility moratorium

The Clayton City Council on Feb. 26 approved a package of ordinances and resolutions that adjust several city codes, authorize project work and extend an existing moratorium on certain residential care permits.

Ordinances and code changes

Council adopted an amendment to Clayton Codified Ordinance 3.51.011 to add a graduated penalty structure for snow‑emergency parking violations, clarify enforcement by citation and towing, and declare an effective date. Staff reported the January snow incident produced 53 violations and 10 tows; the amendment will give staff authority to issue citations in future snow emergencies.

The council also approved an amendment to Part 15, Chapter 1520 (hydrant spacing) of the Clayton Codified Ordinances to better align local spacing requirements with the Ohio Fire Code, and to authorize the fire chief to approve reasonable allowances. The fire department representative explained that strict 300‑foot spacing can force impractical placement and that residential areas may be adequately served with spacing approaches closer to 500 feet in some cases.

Main Street (State Route 48) sidewalk project and contracts

Council declared the necessity and approved appropriation of property for the North Main Street (State Route 48) sidewalk improvement project (MOT 48‑2.06, PID 124483), authorized the law director to file appropriation petitions and to deposit funds for takings and damages, and approved an emergency declaration so work can advance. The emergency and the ordinance passed on roll call; recorded votes in support included Bustos, Henning, Gorman, McDowell, Kelly, York and Farmer.

Council also authorized a professional services agreement with Choice 1 Engineering for design services for Phase 2 of the SR‑48 pedestrian improvement project. Staff said Phase 1 work (this summer) runs from Meijer to Heathcliff; Phase 2 covers Heathcliff to Old Salem, with an anticipated start in 2029 and completion in 2030. Staff noted grant funding and local match obligations associated with the project.

Other resolutions and contracts

Council extended, through and including March 4, 2027, a previously approved 365‑day moratorium (Resolution RO22622) on accepting and processing applications for zoning, occupancy, conditional use and building permits for residential care facilities and congregate residential facilities within the city.

The council also authorized the city manager to accept a proposal from Titan Commercial Flooring Inc. for the Meadowbrook carpet replacement project (Resolution RO22624) and to execute related contract documents.
