Council performs first reading of recycling ordinance to match Wisconsin DNR rules

Fort Atkinson city staff presented a first reading Feb. 17 of an ordinance to repeal and recreate Article 3 of Chapter 86 of the municipal code to align local recycling requirements with Wisconsin Department of Natural Resources administrative rules that took effect July 1, 2025.
Speaker 12 told the council the update includes revised definitions, acceptable materials lists, enhanced education requirements, multifamily and nonresidential standards, collection standards and enforcement/penalties. "To be recognized by the DNR as having an effective recycling program under state statute, the city is mandated to adopt these updated rules," Speaker 12 said, noting failure to adopt would jeopardize eligibility for state recycling grants.
Council asked questions about multifamily/nonresidential impacts and curbside collection details (for example, how lead-acid batteries and motor oil jugs are handled). Staff said many changes clarify communication and that residents must call the contractor for certain pickups. The ordinance committee reviewed and recommended the update on Feb. 3.
Council directed the city manager to prepare the ordinance for a second and possible final reading at the March 3 meeting; the motion passed by voice vote.
Next step: staff will prepare the ordinance language and schedule subsequent readings so Fort Atkinson remains eligible for state recycling grant funding.
