Madera council directs staff to draft commercial color palettes and implementation options

Planning staff presented options on Feb. 18 for how Madera could guide or regulate exterior paint for commercial buildings. Planning Manager David Berlietic reviewed existing design guidelines (used at entitlement) and limited code references (graffiti abatement, boarded windows, telecom tower tone) and said other cities use preapproved palettes, design review boards, or administrative approvals tied to specific districts.
Council members raised multiple concerns: how to treat existing buildings versus new construction, whether repainting should trigger discretionary review, the legal risk of overly rigid rules that could deter national retailers, and the challenge of enforcement if owners repaint without permits. City Attorney Shannon advised that guidelines with safety valves (administrative exception processes and appeals to the planning commission) generally reduce legal exposure compared with rigid ordinances.
Members also discussed creative remedies: using a façade‑improvement or paint‑incentive program (possibly funded from cannabis tax funds) to help bring existing buildings into a preferred palette, and embedding a color‑palette notice into business‑license or real‑estate disclosure processes. Council asked staff to draft proposed color palettes and an implementation program covering new development and existing commercial repaints, to define appeals/safety valves and mural handling, and to propose outreach and potential incentive funding mechanisms.
