The Bryan County Planning & Zoning Commission voted May 20 to approve a conditional-use permit allowing a one-person home hair salon in an accessory building on an R-15 property in the Buckhead East area.
Staff presented the application for conditional-use permit 20250171 and recommended approval, noting the proposed business would operate limited hours (school hours, roughly 9 a.m.–2 p.m.), use the homeowner’s driveway for parking and be restricted in scale. The file included several public emails and at least one in-person speaker opposing the permit.
Applicant Dr. Jared Anderson told the board his wife, a licensed cosmetologist, planned to operate the salon as a hobby rather than a full-time business and expected about "1 person a day." He said the building would be set back and largely invisible from the road and that the HOA had provided an approval email and was represented at the meeting.
Neighbors questioned whether HOA covenants allow a business on the lot and warned of precedent if the county granted zoning permission. Albert Tuis, identified as the HOA vice president, said the HOA had interpreted its covenants to permit home offices or businesses that do not require customers to visit and had approved this request with limitations, including minimal visibility from the road and water. "Except that any home run office or business, which does not require customers to visit them may be operate," Tuis read from the HOA provision during the hearing.
Planning staff reminded the public that county zoning decisions do not enforce HOA covenants; enforcement of covenants is typically a civil matter handled by the HOA or in civil court. With the record closed, Speaker 8 moved to approve conditional-use permit 20250171; the motion was seconded and carried on a voice vote.
The permit allows the one-person salon to operate under the conditions described in the staff recommendation. Any HOA enforcement questions remain a separate civil issue between residents and the HOA.
