County authorized to join proposed Kroger opioid settlement; one supervisor abstains

The Washington County Board of Supervisors approved a resolution authorizing the county to participate in a proposed settlement with Kroger related to opioid claims and directed the county attorney and outside counsel to execute documents necessary for participation.
County counsel explained the county previously adopted the Virginia opioid abatement fund allocation memorandum of understanding and that Kroger’s settlement documents require local approval and signatures to participate. "Without signing this document, you don't participate in the settlement," the county attorney said.
Supervisor Hernandez disclosed he is an employee of Food City, a Kroger competitor, and said "because of that I will not be participating in any discussion and will be abstaining from any of it." The board proceeded with a motion to approve the resolution and to authorize signees; the resolution passed with six votes in favor and one abstention.
The motion included authorization for specific county officers to sign the settlement documents on behalf of Washington County. The resolution directs follow-up by county counsel and outside counsel to complete the county’s participation in the settlement process.
