House labor committee advances two bills in work sessions; HB 40 13, HB 40 12 move to the floor

Vice Chair Munoz moved House Bill 40 13 to the floor with a 'do pass' recommendation. Erin, a committee staffer, told the committee the measure sets the total hours a minor may work at no less than the requirements of the federal Fair Labor Standards Act as of Jan. 1, 2026, allows the Bureau of Labor and Industries to adopt rules to conform to future federal changes, and carries no identified fiscal or revenue impact. By roll call the committee recorded 'Aye' votes from Representatives Fragula, Nelson, Ricky Smith, Vice Chair Munoz, Vice Chair Sharf and Chair Graber; Representatives Bossard Davis and Bunch were excused. Chair Graber announced the motion adopted and asked Rep. Munoz if she would carry the bill on the floor; Rep. Munoz agreed.
The committee then opened a work session on House Bill 40 12. Erin described the bill's dash‑1 amendment: it requires the Construction Contractors Board (CCB) to consult with the Bureau of Labor and Industries (BOLI) to execute a targeted assessment of unlicensed construction labor contractors from Jan. 1 through July 1, 2027; directs CCB and BOLI to plan the assessment by Dec. 1, 2026; permits data sharing under existing authority in ORS chapter 701; requires notice to CCB licensees and a report back to interim business and labor committees by Oct. 1, 2027; and was reported to have minimal fiscal impact.
Vice Chair Scharf moved to adopt the dash‑1 amendment; roll call showed the amendment adopted. The committee then moved HB 40 12 'do pass as amended' to the floor and Vice Chair Scharf agreed to carry the bill.
Both measures will be scheduled for floor consideration by the House. Committee staff said members who could not participate that day were marked excused on the public roll calls recorded during the session.
