Board continues ratification of Spring Mountain Raceway sale after public objections over authority and solar/transmission concerns

The Nye County Board of Commissioners on Aug. 6 continued consideration of a ratification item involving a letter from County Manager Timothy Sutton authorizing Spring Mountain Raceway LLC to sell land to Gridliance West LLC. Public commenters and some commissioners raised procedural and substantive objections, prompting the Board to continue the item to Sept. 4, 2024, for legal review and to align the ratification with related development agreement exhibits.

Multiple members of the public questioned whether the county manager had authority to issue an approval letter prior to board action. Laura Larson said the manager "does not have the authority to approve the sale of a property" and urged an investigation of the letter. Several commenters also raised concerns that the purchase could facilitate solar development or large transmission infrastructure near town; others noted recorded commitments that racetrack land was gifted with restrictions on sale.

County staff and the director of planning said the letter was tied to a previously approved development agreement and special‑use permit (SUP) that granted entitlement for a substation expansion to support Gridliance's line upgrade; they said the sale itself does not authorize solar development and that the property is too small to be a viable solar farm. Staff reported escrow closed on numerous parcels and the letter was intended to allow the last escrow to proceed; the director said a minor exhibit correction was delaying final execution of the development agreement.

After extended public comment and a request from Commissioner Strickland to package the ratification with completed legal review and the final development agreement, the board continued the ratification to Sept. 4, 2024, with a 4‑to‑1 vote. Commissioner Strickland voted to continue; one commissioner voted no.
