Town demands documentation after property owner decommissioned septic and connected to sewer without permit

Board members flagged an unpermitted sewer connection at 1171 Lyon's Drive (former Lazydays, now owned by CIT). Speaker 1 said the property submitted documentation showing septic decommissioning and images of the sewer line work, but "they did not apply for a permit, so there's the tap on fee and they didn't get inspections on this one." The board discussed possible liability because the work was covered before inspections could be conducted.

Speaker 3 recommended the board request an affidavit that the decommissioning and connection were completed properly and asked staff to seek additional documentation that supports the receipts and photos. Speaker 1 asked staff to compile dates, images and any inspection-equivalent documentation so the town can bill the permit and tap-on fees and determine ERUs for the property.

Board members discussed using an estimated employee count to assign ERUs for billing (estimates cited in discussion ranged roughly between 45 and 70 employees for the new building) and agreed to reassess ERUs annually in October. The board asked Clay and Brandon to work with the Porter County Health Department and produce a correspondence and billing package to be sent to the property owner. No enforcement action beyond billing and documentation requests was approved at the meeting.
