The Jefferson County Board of Zoning Adjustment voted to approve a variance that reduces the required 30-foot rear-yard setback to 23 feet for a covered patio at 5144 Georgine Drive in Imperial.
A county planning staff member (Unidentified Speaker, S7) presented the case CB250002 and advised the panel that, after analyzing the site and criteria in the Unified Development Order, staff recommended denial of the requested variance. "Based on the analysis, staff does recommend denial of the requested variance for relief from the required 30 foot rear yard setback to be reduced to 23 feet along the rear property line," the staff member said.
Tony Hobbs of Patriot Builds, representing homeowners Barb and Scott Penier, told the board the proposal would convert an existing concrete pad into a conventionally built covered patio that matches the house. "It's going to be a conventionally built patio cover... We will add some siding to the front gable that will match their house, as well as shingle on the roof, with the shingles that are existing on their home as well," Hobbs said, adding that the homeowner's association had approved the project and that the applicant submitted a neighbor support letter.
Board members questioned the applicability of the uniqueness criterion for a variance, asking whether the lot contained conditions "unique or peculiar to the property" that would justify relief. Planning staff responded that the lot is generally normal in size and shape but does back up to common ground developed with a lake, which staff noted when assessing likely impacts.
After hearing testimony and questions about dimensions (board members referenced an existing pad measured at about 18 by 20 feet and a possible 22-foot width), Unidentified Speaker (S8) moved to approve the application ZB25-two; the motion was seconded by Unidentified Speaker (S5). The board recorded assent (‘Aye’) and the chair announced the motion carried, approving the requested reduction to a 23-foot rear setback for the covered patio.
