Trustee Nancy Washburn, sitting in for Chair Joe Mayer, said the Mount Pleasant Plan Commission unanimously recommended that the Village Board approve the Derby Avenue condominium plat (CP 2601) for 1617–1619 Derby Avenue after asking that the village attorney review quorum and dispute-resolution provisions in the condominium instruments.
The commission's staff presenter, Robin, described the application as a conversion of a twin home into two condominium units on an existing 0.38-acre parcel that was subject to a certified survey map (CSM 2407). "This is a good infill development for the area," Robin said, adding that the proposal meets the village's subdivision chapter (chapter 74) and zoning chapter (chapter 90) and is consistent with the village's master plan.
Why it matters: The commission's recommendation moves the plat to the Village Board for final action. Commissioners pressed for clarity on governance details in the recorded condominium instruments because those private documents determine how two co-owners will resolve disputes and manage shared maintenance over time.
During discussion, one commissioner asked what would happen "20 years from now when you have two people with equal voting rights and they don't get along." Developer Mike Peterson of MPR Holdings replied, "The condo docs speak to all that," and explained that small-condo law and the recorded instruments typically set out dispute resolution. Robin and other staffors pointed to state small-condominium provisions (referenced in the packet as stat 703.360five) that apply to associations of 2–12 units: the statute allows a board, managers, and requires many actions to meet supermajority thresholds; it also directs disputes under that chapter toward arbitration in many cases.
Commissioners also raised a practical concern about long-term maintenance and reserves: Trustee Washburn noted she saw no reserve-collection mechanism in the submitted documents and urged applicants to consider long-term funding for roofs and siding. Commissioners suggested applicants consider a three-member board or manager arrangements so repairs and liens do not unduly burden a single owner.
Motion and condition: Commissioner Michelle moved to recommend approval of the Derby Avenue Condominium Plat (CP 2601) to the Village Board. The commission amended the motion to request that the Village Board packet include the village attorney's opinion specifically addressing quorum and dispute-resolution provisions in the condominium instruments. The commission voted to recommend the plat forward with that attorney opinion attached; the motion passed unanimously.
What happens next: The recommendation will be forwarded to the Mount Pleasant Village Board for final action. Staff said the village attorney's opinion would be available before the next village-board meeting and would be attached to the board packet.
Background and technical details: Staff explained that the parcel was previously divided by CSM 2407 and that converting the property to a condominium plat reassigns responsibilities for common areas through recorded instruments rather than creating separate fee-simple lots. Robin noted the village's zoning code, adopted in recent years, now allows this type of infill condominium development where it would not have been allowed before 2020.
The commission concluded the discussion by recommending approval to the Village Board with the attorney review, then promptly adjourned the meeting.
