Redevelopment counsel recommends $45,751.50 payment to tenant to resolve Showers West litigation

Corporation counsel told the Regal Development Commission on Feb. 23 that the city and the commission are continuing to respond to litigation over the Showers West property and are awaiting a judge’s ruling on cross motions for summary judgment. Counsel said one tenant, identified in the update as Casa, obtained board approval to accept a monetary payment and parking passes to vacate the premises.

The counsel said the commission was asked to approve paying Casa $45,751.50 and providing two parking garage passes for one year; counsel recommended the commission agree and said she would prepare paperwork for the next meeting. “I would encourage this redevelopment commission to agree to pay that amount,” the counsel said in open session. The counsel added that she had checked with parking‑garage staff and that the garage could accommodate two additional parkers.

Staff answered commissioners’ questions about the tenant’s space and the funding source. A staff member reported Casa occupies about 2,882 square feet. The counsel and staff said the payment would come from the RDC general fund (account 2519, formerly numbered 444) and that there are adequate funds to cover the proposed payout.

The counsel emphasized that more details about other tenants and the litigation can be discussed in an executive session and that the recommended payment and parking passes will be returned to the commission as a formal action item at the next meeting for approval and signature.

Next step: counsel said she will prepare and deliver the settlement paperwork to the commission for formal consideration at the next scheduled session.
