The Zoning Board of Appeals approved petition KZBA2555 to add a second floor at 35 Dayton Street, accepting the applicant’s revised design with a specific condition: the removal of the existing full bathroom in the basement.
Jim Chen, identified in the record as the architect for the applicant, told the board the removed ADU element over the garage and said the proposed addition remains within the zoning height limit (about 29 feet). He described the new second floor as a three-bedroom unit with two full bathrooms and noted the first floor would remain an open concept.
Councilor Virginia Ryan Woodford said she reviewed the modified plan and voiced her support at the hearing. A nearby neighbor, Colin Harper of 11 Dayton Street, said he worried the enlarged house could be rented and create on-street parking pressure.
Board members expressed concern that an existing full bathroom in the basement could enable conversion of that space into a separate dwelling unit or short-term rental, increasing parking demand. To reduce that risk the board conditioned approval on removal of the basement full bathroom; the motion to approve with that condition carried on a voice vote.
The board recorded the condition in its approval and instructed the applicant to comply as a term of building-permit review.
