Oldham planning commission holds executive session on Canfield litigation and adds related docket

Before leaving the open session the commission invited counsel Connor Sturgill to join the executive session.
After returning, commissioners voted 13–0 to add a docket item for a future meeting that, according to the motion, will review testimony from the 02/28/2023 meeting and follow the Court of Appeals’ direction to base the decision “solely on testimony of 02/28/2023.” The motion was made immediately after the executive session and carried on a roll call recorded by the clerk.
The action creates an explicit board directive to revisit the earlier testimony as requested by the Court of Appeals; no further public deliberation on the merits occurred during open session. The commission did not announce any substantive decision about the underlying litigation at the public meeting. The next procedural step is for staff to place the specified docket item on a future agenda for the Planning and Zoning Commission.
