Planning commission approves final site plan for Linkwood mineral extraction; MDE oversight emphasized

Dorchester County planning commissioners voted to grant final site-plan approval for Linkwood/Lakeville Ventures LLC’s mineral extraction operation after staff and the applicant described state oversight and site controls.

Agent Steve Witten said the proposal delineates a limit-of-disturbance and includes a locked gate and a no-entry road to keep mining access away from a neighboring mobile-home park. He told commissioners that “everything within that boundary is under regulation of Maryland Department of the Environment mining division,” and that MDE had staked and approved the five-acre mining area and issued the required state mining license.

Staff confirmed the Maryland Department of the Environment (MDE) will monitor reclamation and safety, the county’s Department of Public Works had ruled the operation exempt from county stormwater management review because of the operation’s nature, and soil-conservation comments were being addressed. The county noted the health department’s comments were still pending but not expected to block approval.

Commissioners framed the vote as consistent with state preemption: while the planning commission performs final local site-plan review and approval, the technical and safety oversight of mineral extraction rests with MDE. After brief discussion a commissioner moved, a second was recorded, and the commission approved the final site plan by voice vote with no recorded opposition.

Next steps: the applicant will proceed under the state mining license and county site-plan approval; staff will continue to track outstanding agency comments and coordinate any state-required inspections.
