Lorain demolition board places 446 Delaware back on demo list after ownership transfer

The Lorain Demolition Board of Appeals voted Oct. 16 to return 446 Delaware Ave. to the city’s demolition list after staff told the board the parcel sold at sheriff's sale and transferred to a company in Atlanta.
Chief Building Official Dave Fasiano told the board that while permits issued under the former owner never progressed to inspections, “that property did sell at a sheriff sale,” and the new owner has not yet contacted city staff. Legal counsel advised the board it must notify the new owner of the existing demolition order so the new owner can appeal or state plans for the property.
Chair members moved to place the property back on the active demolition list and to send the new owner a copy of the demolition order and the applicable ordinance; the motion carried on a voice vote. The board did not remove the property from the list and said staff must follow notification procedures before any further action.
The decision preserves the board’s prior finding of unsafe conditions while giving the new owner formal notice and an opportunity to seek relief or file plans. No inspection reports, timelines or a remediation schedule from the new owner were presented at the meeting.
The board moved on to other pending cases after the vote; staff said they will document the notice and any subsequent appeal or response from the new owner.
