Council approves Cosmock amendment and Highway 99 water-main contract; recusals recorded

The Modesto City Council on Feb. 24 approved several consent items that included a consulting amendment for a proposed sports and multiuse development and a construction contract for Highway 99 water-main improvements, with recusal notes recorded for members with property conflicts.
The council approved a second amendment with Cosmock Companies to expand its scope of services to include fiscal and economic impact analysis, market and financial feasibility review, public funding and financing advisory and negotiation support for a proposed sports and multiuse development. The motion to approve the amendment passed 6–0, with Vice Mayor Williams recused from the vote because the items concern property near his ownership.
Council also accepted plans and awarded the Highway 99 water-main crossings improvement contract to Construction Incorporated of Atwater, California, for $1,436,035 and authorized up to 20% contingency for a total not to exceed $1,723,242. That item also passed with a 6–0 vote and one recusal.
Earlier in the consent sequence the council approved an additional payment of $70,150 to Pacific Gas and Electric for gas-line relocation on State Route 132, bringing the city’s total commitment to PG&E for the project to not exceed $350,872. Council member Alvarez recused himself from that vote; the item passed 6–0 with his recusal recorded.
A student speaker, Hugo Bettencourt, urged the council as it considered the Cosmock amendment to include youth access and workforce opportunities in feasibility analyses. Council members recorded the recusals on the public record before voting.
What this means: The Cosmock amendment advances further study and advisory work for the sports/multiuse project but does not itself authorize construction or public funding beyond the consultant contract. The Highway 99 award commits funding for construction under the terms stated; contingencies are authorized by council action.
