The council opened a discussion of resolution M‑3 after a member asked what the item would accomplish. Unidentified Speaker 3 said the board appointed a commissioner in October to the Pecan Lake Recreational Improvement District but later questions arose about whether a vacancy existed and whether the newly effective statute’s notice requirements were followed.
Why it matters: If the district failed to provide statutorily required notice to property owners, an improperly seated commissioner could have participated in votes that would be legally vulnerable, potentially delaying district actions in the spring.
Councilors were told the statute was approved in March or April and took effect in August; the questioned appointment occurred in September/October. Unidentified Speaker 3 said the October appointment should be set aside unless the district can show proof that every property owner within the district received notice. “The appointment of, the commissioner in October needs to be set aside, and we need to make sure that steps are followed,” Unidentified Speaker 3 said.
Another unidentified speaker said the district had secured an attorney and that the attorney and a staff member named Lynette had discussed the matter; but Unidentified Speaker 3 said a written memorandum from Lynette shows steps were not followed. The council asked staff to provide documentation proving appropriate notice and service by the next meeting. Staff said they would send detailed notice to district property owners by email, regular mail and phone call and would supply any records of service.
Several councilors asked whether delaying action on M‑3 would impede the district’s pending work. Unidentified Speaker 3 warned that if an improperly seated commissioner had participated in prior votes, those votes could be contested and slow district business. Vice mayor Wyatt asked that M‑3 be held separate from the consent agenda so residents can be notified and have time to appear.
Next steps: Staff will send notices to district property owners and provide documentation to city officials before the council’s scheduled Tuesday discussion. No formal vote on M‑3 was recorded in the transcript.
