Representatives Brooks and Stewart introduced a technical cleanup to the Public Trustee Act foreclosure procedures intended to modernize statutory language, update timelines and reduce procedural confusion. Sponsors said the changes do not expand foreclosure rights but instead clarify timelines, definitions and reporting requirements.
A key substantive change discussed in committee clarifies that minor, non‑material errors on the Notice of Election and Demand (the recorded NED that initiates foreclosure) will not require restarting the foreclosure process; sponsors said this targets administrative errors such as typographical mistakes that do not affect title or substantive creditor rights.
County treasurers and public trustees from Arapahoe, Douglas and Larimer counties testified in support and walked members through operational impacts. Larimer County’s deputy public trustee asked that the unclaimed overbid funds period be extended from six months to two years to increase the chance that former owners can be located. The Treasurer’s Office supported that change and an amendment to do so was adopted.
The committee moved the bill, as amended, to the Committee of the Whole with a favorable recommendation; the roll‑call vote was unanimous (13–0).
Next steps: bill will proceed to the Committee of the Whole; sponsors and county officials noted follow‑up on implementing consistent reporting and unclaimed funds processes.
