Staff warned that once allocation commitments push the plant past an 85% threshold the county may consider recapturing unused or dormant EDUs on a case-by-case basis with property-owner coordination and separate county approval.
Joe Manning, identified in the meeting as the Town Manager of Millington, said the town has a few concerns and is seeking a temporary outside legal opinion before finalizing its review. County staff said they do not seek signatures immediately and expect the town to complete legal review in the coming month or two, after which the agreement would likely return to the board as a consent-item signature.
What happens next: Staff will continue coordination with Millington, incorporate legal edits, and bring a finalized agreement to the commissioners for formal approval once the town completes its review.
