Mister Zacharias, planning, zoning and engineering, reiterated the recommendation that council respect the applicant's request and vote "no" to defeat the legislation so the matter could be closed.
The council considered motions, including a procedural motion to reconsider, then took a final roll-call vote on adoption. A motion to adopt the ordinance failed on the record; the roll calls recorded council members voting to defeat the measure, consistent with the administration's recommendation tied to the applicant's withdrawal. The motion to adopt was moved by Mister Clark and seconded by Miss Roth.
The ordinance listed the parcels by permanent parcel number (19156 Pearl Road, PPN 39431007; nearby vacant land PPN 39432001) and would have amended the city's zoning map (section 12.50.03 of Title 6, Part 12 of the codified ordinances). Because the applicant withdrew, council members stated they would honor that request while preserving the city's ability to consider future rezoning requests for the parcels.
The public hearing record will remain in the file, and no further action on this ordinance was taken at the Jan. 20 meeting.
