Commission accepts $25,000 credit and approves final change order for indoor pavilion

Project manager Ben Roberts summarized the components covered by change order No. 4: additional electrical work to provide a second 250-amp circuit required for a commercial kitchen stove, installation of concrete bases for exterior light poles, and widening an opening in the restroom walls to meet accessibility clearance where a water fountain was to be installed. Roberts reported the assembled items on this change order total approximately $9,648.73.
Roberts said the project missed its June 30 completion deadline by roughly 80 days; liquidated damages at the contract rate could have been greater than the negotiated credit (a staff estimate placed potential liquidated damages near $40,000). County legal counsel and staff recommended accepting the contractor's $25,000 credit as a reasonable compromise, noting some delays were tied to weather and equipment delivery, and that pursuing full damages could be more costly than the settlement.
Commissioner Martin raised concerns about weekends when work might have been possible; county staff acknowledged both weather and scheduling choices by the contractor had contributed to the delay. The commission approved both the change order and acceptance of the $25,000 credit by voice/roll-call vote.
The commission asked staff to continue pursuing completion and to return with final close-out documents and the credit application for the project record.
