The City Commission of the City of Sunny Isles Beach approved a variance and site‑plan modification for the Turnberry Ocean Club (planning application PZ2024‑03), allowing five street trees on Collins Avenue instead of the seven required by code.
City planning staff told the commission the project is fully constructed and the variance is needed because newly installed utility and water‑main equipment and Floridapower & Light (FPL) and North Miami Beach water easements at the northwest corner of the site make planting the two additional street trees infeasible. The staff presentation noted the overhead utility lines and poles previously on the site have been removed.
Dan Atkins, president of governmental affairs for FoundBlue Development, represented the applicant and said the developer had intended to plant the seven trees but that site conditions now preclude it. Atkins offered a contribution to the city’s traffic fund equal to the city's landscaping charge — "around $20,500," he said — and asked that the contribution be incorporated as a condition of approval.
City counsel confirmed the commission could make that contribution a condition and incorporate it into the resolution. A motion to approve the site‑plan modification and variance with the applicant’s contribution as a condition carried on a roll call vote; the chair announced the application approved 4‑0.
Next steps: the item was approved during the zoning hearing and the applicant will pursue final certificate of occupancy consistent with the approved site plan and any conditions the commission adopted.
