Commissioners debate scope and legal framing of proposed rule‑of‑law resolution ahead of March 3 meeting

At the Feb. 24 work session, commissioners debated amendments proposed for a draft rule‑of‑law resolution. The discussion centered on three proposed amendments: (1) language alleging violations of Fourth Amendment rights by federal immigration officers, (2) a provision directing the county to review constitutional compliance, and (3) text supporting legislation before the U.S. Congress.

Several commissioners cautioned that amendment No. 1 makes a legal conclusion the board cannot independently verify without evidence and that it would be inappropriate for the county to assert the alleged federal constitutional violations on the board’s behalf. County staff and counsel advised that if the board desires this language, it would be taking on responsibility for stating it as fact and recommended reworking to avoid legal conclusions. The board discussed whether County Counsel should review suggested amendments and whether amendments should be refined and integrated into the draft to ensure longevity and clarity.

Commissioners agreed to continue work on the drafts and for authors of proposed amendments to coordinate with colleagues and County Counsel before bringing revised text forward at the March 3 business meeting. The board did not adopt any amendment at the work session.
