County committee presses staff on SERVPRO emergency thresholds and unpaid subcontractor wages

Manuel Barca, chair of the public works committee, and committee members pressed Public Works staff over how the county uses term-and-supply contracts for emergency repairs, the adequacy of emergency notifications and how subcontractor pay is protected during contract closeout.
Brian Gatti, public works, said the department prefers using term-and-supply contractors because they know county facilities and can respond quickly to water intrusions and other small emergencies. He said small emergency calls are often low-dollar, but the county needs guidance on when to escalate to procurement that requires broader competitive processes. "The reason we like Servpro for our emergency, term supply is for these small water breaks that need to be cleaned up immediately," Gatti said.
Committee members sought a clear dollar threshold for when staff may call a term-and-supply vendor without prior legislative or broader administrative approval. Barca said he wants emergencies under a threshold (he suggested thinking about $50,000) handled promptly, while larger responses should be bid or brought before the legislature. "When it rises above the threshold over a weekend of maybe $100,000...that to me needs to be bid," Barca said.
The meeting also covered contract closeout and subcontractor pay. Gatti said the prime contractor retainage held by the county is currently $14,800,000 and would be $15.2 million by project end; retainage will not be released until compliance and fiduciary issues are reconciled. Barca warned that withholding retainage from a prime contractor does not directly stop subcontractor workers from being unpaid and urged use of restitution policies or other mechanisms to protect workers who have not been paid overtime or wages.
On emergency declarations, Gatti acknowledged gaps after personnel changes and said Public Works will follow county rules and contribute to creating a consistent process going forward. The committee agreed to delay a formal resolution on SERVPRO for at least a week to let legislators and staff develop proposed thresholds and procedures; Barca and Legislator Arbo will work with Public Works on specifics.
