Sweet Home board pulls multiple health and safety policies after debate over menstrual-product wording

The Sweet Home School District 55 board voted to remove a set of health- and safety-related policies from third-reading consideration after members raised concerns the district template could go beyond state requirements for menstrual products and other health provisions.

At the Sept. meeting, a board member said proposed language in the student-health-services packet would put dispensers “in every student bathroom,” language that prompted questions about whether the draft exceeded Oregon law. Another member pointed the board to a state statute and administrative rules and said they wanted more time to confirm the district’s template matched the statutory and administrative requirements.

Board members debated a footnoted reference to ORS 326.545 and implementing Oregon Administrative Rules. One board member (Board member (S10)) read aloud a version of the statute during discussion: “each public education provider shall ensure that both tampons and sanitary pads are available at no cost to students through dispensers located in at least 2 student bathrooms of every public school building.” Members asked whether the district template’s wording — which in places appeared broader — correctly reflected that requirement.

Questions during the discussion also covered whether combining older policies (for example, a separate first-aid policy) into a bundled EBBA student-health-services policy had inadvertently deleted or altered required language. Members sought clarity on formatting and references in administrator-evaluation language and on an infection-control (bloodborne-pathogen) draft that includes training and vaccine-offer obligations that could expand district responsibilities.

Citing those uncertainties, a board member moved to remove the set of E-series policies and associated administrative rules from consideration and defer them for reevaluation at the next board meeting. The motion passed by voice vote. The board approved the remainder of the policy package that did not include the pulled items.

The board scheduled the pulled policies for additional review at a future meeting; the district staff said they would provide clarifying information and statutory references to help the board determine whether the draft language matched state law and administrative rules.

The board’s action leaves the EBBA-series items under reconsideration and advances the rest of the third-reading policy package.
