Banks SD 13 board approves CMGC procurement for Ox Gym, links Kelly Field work

The Banks SD 13 Board of Directors voted Feb. 18, 2025 to approve a recommendation to use the Construction Manager/General Contractor (CMGC) procurement process for the Ox Gym middle-school project and to link Kelly Field and golf-facility work into that procurement. A motion to approve the recommendation was made, seconded and carried.

District staff told the board the CMGC approach allows early contractor involvement, which is critical for long-lead items such as steel orders, and makes it easier to package work to use local contractors and break bids into manageable packages. "Having the contractor on board early really is helpful, and the CMGC process will, really help us with that," said the presenter (speaker 7).

Board members asked how the linked Kelly Field work would be funded given that the field campaign is privately fundraising. Staff said donation funds would be deposited with the district and accounted for separately from bond proceeds so that each funding source pays only its portion of work. "We can break out the billing and pay applications, even create stand-alone pay applications," the presenter said.

A board member (speaker 8) moved to approve the CMGC recommendation as outlined on the agenda; the motion was seconded and the board voted to approve the action. The transcript records affirmative votes and the chair declaring the motion approved. The board also reiterated that prevailing-wage requirements apply to construction on district property and that the district will follow legal advice on those requirements.

Next steps identified by staff included issuing an RFP for CMGC services and, for the Ox Gym specifically, early procurement of long-lead materials. Staff said final commitments for individual construction packages occur when bids are accepted for those packages.

The board is scheduled to meet next on March 10, when staff said they will bring follow-up materials.
