The Planning Commission voted 5-0 to recommend City Council approve a text amendment to Section 20‑3‑152 that would add vehicle and equipment sales, rental and service as a specific use permit (SUP) in the CB, or Commercial Business, zoning district.
Henry Bibelheimer (Development Services) said staff found five existing uses in the CB district that fit the proposed definition (mechanics, a used car lot and similar businesses) and that the amendment would provide a path for those nonconforming uses to come into compliance if they move or expand. He said the SUP process would require public hearings before the Planning Commission and City Council and would allow conditions to be imposed.
Staff recommended the amendment; Commissioner (S5) moved to accept findings and recommend City Council approve Text 26‑3, the motion was seconded and passed 5‑0.
The amendment does not require existing nonconforming businesses to change but provides a formal route for future proposals and imposable conditions through the SUP process.
