Planning commission approves recommendation for Popeye’s site plan and parking deviation

The Planning Commission on Oct. 27 recommended approval of rezoning and approved the preliminary and final development plans and plats for a proposed Popeye’s drive-through restaurant at the northwest corner of 188th Street and South Gardner Road.
Dan Finn, civil engineer with Phelps Engineering representing the developer, said the proposed building would be about 2,700 square feet with a drive-through and that the applicant sought an increase in maximum parking. City staff confirmed utilities are available, described the proposed building materials and elevations, and recommended approval of a deviation to allow additional parking (the applicant proposed roughly 29 spaces versus the code’s one-space-per-three-seats standard).
Commissioners asked about access off a private drive (100–187th Terrace), cross-access easements to adjacent properties, and whether the private drive would remain the developer’s maintenance responsibility; staff and the applicant said private-drive maintenance would be the responsibility of adjacent property owners or an association and that cross-access easements are planned.
The planning commission recommended rezoning with the requested deviations and approved related plats and the final development plan with conditions; each motion carried 6–0. The items will move to the governing body for final action.
