The Sanford Planning Board approved a minor site-plan application on Sept. 2 that grants after‑the‑fact shoreland approval for a basement foundation installed under an existing dwelling at 185 Fife Lane, but the approval is conditioned on the applicant finalizing a consent agreement to resolve a 02/23/1987 court order tied to the original installation.
Jamie, planning staff, told the board the shoreland ordinance was updated in 1997 to permit basements under certain conditions, and staff reviewed photographic evidence suggesting the existing foundation was not raised more than the ordinance’s three‑foot limit. The matter was originally the subject of litigation decades ago; staff recommended a consent agreement between the city and the property owner as the practical way to resolve outstanding penalties and close the old court matter.
Property owner Mark Favales described installing the foundation more than 30 years ago when he was 22, said he did not intend to flout rules and that the foundation space has not been occupied. He told the board he plans to work with staff to finalize the consent agreement.
Board process and conditions: The board adopted the staff findings that the site plan meets required shoreland standards (citing multiple code sections) and approved the application with standard conditions. A specific condition requires the applicant to work with the director of code enforcement and planning staff to finalize a consent agreement that addresses the 02/23/1987 court order by the date listed in the conditions (staff asked for revised plans or paperwork by Oct. 17, 2025, unless other arrangements are made).
What this means: The approval recognizes that the current ordinance can accommodate the existing foundation but also ensures the prior legal matter (the 1987 court order) is addressed through a formal consent agreement between the property owner and the city. The city manager does not need to submit the agreement to the council for acceptance, per staff’s explanation to the board.
Next steps: Applicant to finalize the consent agreement with staff; the board’s approval is contingent on that agreement being completed.
