Planning and Zoning Commission backs rezoning for 7609 North 40 Road

The North Richland Hills Planning and Zoning Commission voted 7-0 to recommend approval of zoning case ZC25-0153, which would reclassify 7609 North 40 Road from RE1 (residential estate) to R2 (single-family residential) so the parcel can be subdivided.

Clayton Husband, a city planning staff member, told the commission the 1.2-acre property was rezoned in 2011 to address an accessory structure and that the current request would return the site to its earlier R2 designation to enable a front lot and a rear lot for a new house. “This is consistent with the land use plan,” Clayton said, noting the request aligns with the Vision 20 recommendation for low-density residential.

Applicants Mike and Michelle Maddock said they want to split the lot, sell the front house and build a “forever home” on the rear lot so their family can remain in North Richland Hills. “We don’t have to leave North Richland Hills or a kid doesn’t have to change school,” Michelle Maddock said.

Commissioners asked technical questions about setbacks, the accessory building on Buck Street and minimum R2 lot dimensions; Clayton said staff located the original permit for the accessory structure and confirmed it meets setbacks, and that approval of the zoning change would allow the platting and permitting required to split the lot to proceed as administrative steps.

A motion to recommend approval passed 7-0. The commission’s recommendation will be forwarded to the North Richland Hills City Council, which is scheduled to hold a hearing on the case on Feb. 9.

The commission did not receive any public opposition at the hearing and closed the public comment period before voting.
