Pflugerville council authorizes eminent domain steps for road and wastewater easements

Pflugerville city staff told the council on Nov. 12 that negotiations with property owners had not produced agreements and recommended authorizing condemnation proceedings for two separate projects.
For East Pflugerville Parkway, staff said a parcel (near H‑E‑B) is needed for right of way and drainage; an updated appraisal (Jan. 2025) and a final offer mailed in August left the parties "off by approximately a couple million dollars," staff reported. Council voted to move to executive session to discuss litigation and then returned to approve proceeding with eminent domain authority to acquire the parcel.
Separately, staff sought authority to acquire a temporary construction easement and a wastewater easement for the 18‑inch Gilliland Creek interceptor project, saying the existing line is undersized for growth in the area and that the owner had requested mediation. Staff described the new easement as increasing the existing corridor to a 30‑foot total easement for excavation and larger pipe. Council approved the action to proceed toward condemnation if necessary.
City staff said valuation and court processes will follow statutory procedures and that litigation or mediation remain options; council's votes were procedural authorizations to allow the city attorney to initiate condemnation under Texas law.
