Nixa council approves revised heavy-equipment hours and permitting, adds heat-advisory exception

On Feb. 24 the Nixa City Council adopted an ordinance (Council Bill 20-26-06) changing city code to update heavy-equipment hours of operation, noise standards and a permitting exception tied to National Weather Service heat advisories.
Planning and Development Director Scott Gabby told the council staff recommends the changes and that, among other items, the update would allow crews to start work an hour earlier if the National Weather Service issues a heat advisory for that day. The ordinance also creates a permit process for contractors who want earlier start times so city staff can track exceptions and enforce the rules more consistently.
"So this will be establishing, like, a permit process for those that want to go earlier than 7AM or 7PM," Gabby said, describing the mechanics of tracking and enforcement. Councilors asked whether weekend hours should differ from weekday hours for clarity; staff and council generally favored maintaining a single, uniform time for consistency in public communications and enforcement.
The council discussed enforcement responsibilities and confirmed police will take noise complaints outside regular business hours. A police representative said officers are comfortable handling those calls and that the city intends to prioritize education before enforcement.
After discussion the council moved, seconded and approved the ordinance on second reading by roll call.
