The Warwick School Committee voted to approve a project labor agreement after discussion about an appended letter from a union and language that members said predated the Supreme Court’s Janus decision.
Counsel Connolly, who presented the PLA, told the committee the core document is largely unchanged from prior drafts but that a union-submitted letter has been added as an appendix. He said the letter and some wording make clear there is no requirement for union dues and described the appendix as an offered option rather than a new performance obligation. “In the letter the letter is essentially a choice, not an obligation,” Connolly said. “We can choose to behave in that manner if we find it in our best interest, but we don't have to.”
The debate centered on whether the appendix carries contractual weight and whether it conflicts with the Janus decision, which prohibits compulsory public-sector union fees for nonmembers. Connolly and other speakers noted the appendix was drafted before Janus and emphasized that the district cannot force union membership. He added that any dispute could be raised through the PLA’s grievance process and, if necessary, litigated, but that the PLA’s dispute resolution mechanisms are designed to avoid work stoppages.
Supporters said the PLA provides a predictable framework for large projects and streamlined dispute resolution. Opponents raised concerns that the appendix, as written, could be perceived as creating an obligation for nonunion workers to pay dues if they are used as “key personnel.” Connolly reiterated his reading that the letter presents an option for parties and that it does not impose a new performance requirement on the district.
A motion to approve the PLA “as presented” was moved by Mr. Holmes and seconded by Superintendent Danbrook. The chair called the vote and recorded one opposition (recorded in the meeting as Mr. Lucy); the chair then announced the motion carried.
The committee did not amend the PLA on the floor; Connolly said staff would continue to track language and the practical effects of the appendix as projects proceed. The committee moved on to the rest of the agenda after the vote.
