Council approves specific-use permit for mineral extraction near Northwest Stallings Drive

The Nacogdoches City Council unanimously approved a specific-use permit for mineral extraction on approximately 3.3 acres on Lot 17-5, City Block 95, near Northwest Stallings Drive.

Juan Paulette, interim city planner, told the council the applicant, Drury Wheaton Investments LLC, plans to level the site to roadway grade and later construct a commercial building. Paulette said the property is zoned B-2 General Business and that approval of the SUP would not change the underlying zoning; staff recommended approval with conditions including daylight-hours operation, preservation of vegetative buffers, installation of silt fencing, maintenance of the roadway free of mud and debris, and a 12-month expiration for the permit.

Council members asked clarifying questions about whether the request was a zone change (Paulette said it was not) and about the daylight-hours limitation; Paulette confirmed the condition limits operations to daylight without specifying a clock time and said the applicant could seek an extension if needed. Paulette also noted the Planning and Zoning Commission voted unanimously to recommend approval.

With no members of the public speaking for or against the SUP, a council member moved to approve the permit with staff conditions. The council voted in favor and the motion carried unanimously.

The approval includes the conditions outlined by staff; the permit will expire after 12 months unless extended by the council or staff action. The applicant was not present for the hearing.

Next steps: any extension or request for modification would return to the council for consideration.
