Council approves placing easement resolution on table and votes to hold executive session on pending litigation

The Committee of the Whole on July 10 moved to place a resolution concerning an apparent 1981 easement for a parking lot on the council agenda and voted to enter executive session at the end of the meeting to discuss pending litigation.

Law Director Van Baukenkru told the council that a 1981 easement between the village and the Eagles could not be found in the county filing records and that some signatories identified on the document "at least 2 of them have passed away," so the village will prepare a resolution authorizing new signatures and file the document. "My plan is to ask to put have a resolution, authorizing basically their the signature of this document that should have been signed in 1981 so that we can go ahead and... get that filed in downtown," Van Baukenkru said.

Councilmember Schultmeyer moved to place the resolution on the table for consideration; Councilmember Esteb seconded, and the motion was adopted by voice vote. The council later voted on a separate motion to go into executive session to discuss pending litigation; the clerk recorded seven ayes and no nays and the motion carried.

Separately, Safety & Service Director Williams reported that Fifth Third Bank completed its procurement and selected ABCO as the low bidder to do the parking-lot work, with the village expecting work to begin shortly after an unspecified move-out concludes in early August and requesting three days' notice to residents prior to work.

Chair members said the council met in executive session on pending litigation and that officials will return with a resolution and likely an appropriation ordinance at a future meeting.
