Commission backs ordinance change to make vehicle fueling stations a special use

The Crown Point Plan Commission voted unanimously (7‑0) to forward a zoning text amendment to the City Council that would change vehicle fueling stations from a permitted use to a special use in certain commercial and industrial districts.
Josh Watson of the Planning Department told the commission the change is corrective and proactive: the zoning table currently lists "vehicle fueling station" as a permitted use in some districts but the term is not defined consistently in the code, which has led to contradictory interpretations. "We need to change the use so that way we're still following the same standards we've been following, which is the special use process," Watson said, explaining that the special‑use path lets the city set conditions such as hours of operation and require additional environmental or design studies when a fueling station is proposed near residences.
Commissioners and staff cited past cases in which permitted fueling uses limited the city's ability to set operation hours or require mitigation. By moving fueling stations to a special use, the city gains a formal process to limit impacts on adjacent residential areas, require environmental safeguards and set lot‑ and operation‑level conditions.
The commission made a favorable recommendation and will forward the ordinance amendment to City Council for formal consideration at its next meeting.
