Trustees say restraining order remains in place as hearing over radioactive waste shipments is delayed

Deputy Supervisor Joseph told the Board of Trustees that Canton Township and several neighboring jurisdictions have a temporary restraining order preventing Wayne Disposal from accepting radioactive waste from a site in Lewiston, New York. "We were able to get a restraining order against Wayne Disposal from accepting radioactive waste," Joseph said, adding that the order will remain in place until a judge hears evidence at the adjourned hearing.

The restraining order was obtained as part of a coalition of plaintiffs that now includes Canton Township, Van Buren Township, Belleville, Romulus and Wayne County. Joseph said the evidentiary hearing had been adjourned and was rescheduled so the judge could review arguments from both sides. The board was told the court will decide whether to issue a temporary injunction that would bar Wayne Disposal from accepting the disputed shipments.

Resident Mr. Miller raised concerns during public comment about whether the facility was certified to accept low‑level radioactive materials and the history of nearby disposal sites. "That stuff, evidently, according to the papers, been up there 75 and 80 years," Miller said, pressing trustees about licensing and local notification. Joseph and other officials responded to say the restraining order and the pending hearing are the current legal avenues to resolve those concerns.

The board did not take a new vote on the matter at the meeting; officials said they will report back after the court rules. The next scheduled status update will follow the conclusion of the evidentiary hearing.
