Sedona council moves into executive session over claim by Latera 11 20, LLC and Abionte Creekside negotiations

The Sedona City Council voted to enter an executive session to receive legal advice and to consider settlement and contract-negotiation strategy related to a notice of claim involving Latera 11 20, LLC and the proposed Abionte Creekside development agreement.

The presiding officer opened the meeting and read the executive-session justification, saying, "the council may hold an executive session that is not open to the public for the following purposes," and naming consultation with the city attorney for legal advice and settlement discussions in the matter of "Latera 11 20, LLC" as well as discussion of contract negotiations concerning the Abionte Creekside development agreement. The presiding officer cited executive-session authority under Arizona law as the basis for closing the session.

Councilor Fultz moved that the council enter executive session; another council member formally moved to include both item 3(a) and item 3(b), and a colleague seconded the motion. The council took a voice vote; the transcript records at least one "Aye," and the presiding officer announced assent. Before the motion, the clerk conducted roll call, calling Mayor Jablow, Vice Mayor Plueck and Councilors Dunne, Fultz, Furman, Kinsella and Fock and recording them present.
