Magistrate finds John Tate property in compliance after cleanup, waives daily fines

The magistrate noted a prior order had assessed administrative costs and said he would add another $120 for the current hearing. He declined to impose the previously threatened daily fines, saying he would not impose a fine now in light of the property's current compliance and that Mr. Tate's VA mortgage and veteran status weighed into his discretion.
The magistrate directed the file to show compliance and instructed staff to include the updated administrative costs in the order.
The hearing record shows code enforcement performed periodic checks and that the owner or those acting on the owner's behalf removed previously cited items in advance of the compliance hearing.
