County declines immediate action on Gulf Boulevard property dispute after mixed board reaction

Gary Turner addressed the board on Jan. 20 to request a resolution that would end county litigation over property at 7315 Gulf Boulevard and allow him to move forward with contracting and remediation. "I just need a vote on the resolution proposal so I can sign the agreements and move forward with everything," Turner said.
Commissioners debated whether to act. One commissioner — whose district includes the property — said the matter had been litigated for years and recommended leaving it to the appellate court to decide. Another commissioner said a negotiated settlement could be considered if it included contractor assurances and firm completion deadlines.
County counsel told the board he had prevailed on summary judgment several months earlier and described the proposal as unrealistic in its current form: "I prevailed on summary judgment some months ago...this proposal is a non‑starter," he said, adding that any acceptable settlement would need measurable completion milestones, a licensed general contractor managing the project and enforceable penalties if work were not completed.
With no consensus to adopt Turner's resolution on Jan. 20, the board took no action and indicated it would leave the matter to legal counsel and the courts while counsel and the property owner continue to discuss possible terms.
