Mesquite planning commission postpones CUP request for wholesale nail-and-beauty supply at former Academy Sports site

The Planning and Zoning Commission on Oct. 13 voted 6–0 to postpone zoning application Z0925-418, a conditional-use permit request from Sam’s Nails to allow wholesale nail-and-beauty-supply operations at the former Academy Sports building, to the commission’s Oct. 27 meeting.

Commission staff planner Tiara Clark told commissioners that the applicant requested the delay to meet with city staff and departments, including building, fire and the city attorney’s office, and said the applicant is bringing on land-use counsel to strengthen the application. "The applicant is bringing on their land use counsel to sit down with city staff to discuss the application, as well as with other departments like fire and building," Clark said.

Clark noted the location had previously been the subject of a similar conditional-use permit request in 2021 that the commission denied 5–1. Commissioners pressed staff on timing and whether the delay was due to staff or applicant actions; Clark said the delay stemmed from the applicant’s timeline and that staff had advised the conditional-use route. After discussion the commission voted to postpone and leave the public hearing open.

The postponement was made by motion and second, and the chair announced the motion carried with a 6–0 vote. No public speakers asked to address the commission on this item during the meeting.

The applicant is expected to return to the Planning and Zoning Commission on Oct. 27; the commission did not take final action on the zoning request at the Oct. 13 meeting.
