The Fairfax Planning Commission approved two residential permit applications on Feb. 19: a bedroom-and-bath addition to an existing A‑frame studio at 202 Tamalpais Road, and a 254‑square‑foot garage at 66 Creek Road.
Planning staff told commissioners the Tamalpais project is a 50% remodel that triggers a conditional‑use permit and a parking variance because the property shares driveway and parking with 200 Tamalpais. Staff said the project footprint is on relatively stable ground behind an existing retaining wall and that required findings can be made if the applicant records an easement identifying shared parking before a building permit is issued. "We can make the findings for both the required conditional‑use permit and for the parking variance," planning staff said, noting standard dark‑sky lighting and other conditions in the resolution.
Commissioners asked specifically about the five parking stalls that are located on the neighboring property and whether the recordation of an easement is documented; staff said a recorded easement could not be found and recommended a condition requiring recordation prior to issuing a building permit. A neighbor who spoke in person said the arrangement has worked for years and voiced support for the project. Commissioner motioned to approve Resolution 2026‑01, which passed by roll call. Staff noted a 10‑day appeal period.
On 66 Creek Road, staff said the 254‑square‑foot garage is needed because a prior conversion created a junior ADU (JADU) and the lot does not meet the 60‑foot minimum width; the project therefore requires a combined side‑yard setback variance. Staff reported the garage would match existing siding and roof materials, would comply with dark‑sky lighting standards, and would not require tree removal. Commissioners asked clarifying questions about floor‑area ratio and minor corrections to the resolution text; no members of the public spoke. Commissioner Newton moved to approve Resolution 2026‑04 (application 2602); the motion passed by roll call. Staff again noted the 10‑day appeal period.
Both approvals were presented with corrections to resolution numbering and clerical items that staff said would be fixed before finalization. The commission recorded the approvals in the meeting minutes and closed those agenda items.
