Biscayne Park advances first reading of ordinance to ban construction on federal holidays with clarifying language requested

The Village Commission on Nov. 4 advanced the first reading of Ordinance 2025-03, which would bar construction activity in residential zones on federal holidays, while directing staff to clarify the definition of "construction" so it does not unintentionally penalize homeowners performing unpermitted maintenance.

Brad (S5), the village attorney, read the ordinance which would amend Chapter 18 to prohibit work described as "erection, excavation, demolition, alteration or repair of any building or delivery of materials" on federal holidays. Commissioners and residents raised concerns that the definition could sweep in routine homeowner work such as interior painting or pressure washing that does not require permits.

Manager Al (S14) and Attorney Brad discussed options: tie the prohibition specifically to work that requires a permit under the Florida Building Code, or otherwise exempt interior, non-permitted maintenance. Brad said the current text is "fairly general" and offered to return with redrafted language; commissioners asked that the revision explicitly avoid creating unintended enforcement against residents doing minor, non-permitted tasks.

Several commissioners supported including all federal holidays rather than choosing a subset, citing consistency with neighboring municipalities and sensitivity to diverse resident observances. The ordinance passed first reading "as amended" with direction to staff to present narrower language and a definition at second reading.

No final change to the code was adopted at this meeting; staff will prepare revised language and a report on the frequency of construction-related noise and complaints for the commission to review at second reading.
