The Zoning Board of Appeals concluded that a proposed fifth modification to a Chapter 40B permit for the Residences of South Brookline (101 Thornton Road / 101 Asheville Road) is likely substantial and will be heard at a joint public hearing on December 5, 2024.
Steve Schwartz, counsel for the applicant, summarized the requested changes (amendments to the parking-management plan and the transportation-access agreement) and confirmed the applicant will not contest a board determination that the modification is substantial. Planning staff said the applicant provided written permission to hear the matter beyond the 20-day notice requirement. The board, citing the relationship between the proposed changes and an outstanding Mod 4, agreed unanimously that the modification should be treated as substantial and scheduled the combined hearing on December 5, 2024.
Nicole Pare (planning staff) and applicant representatives said they will present modified language addressing prior town-counsel comments at the December hearing.
