City staff and the city attorney explained that the Brevard County property appraiser/tax collector can issue tax-parcel identifiers without the city's subdivision review; a county tax-parcel split does not replace the city's lot-split process. The attorney explained staff negotiated a reciprocal-easement declaration and that the city will condition approval on recorded reciprocal easements and the mortgagee's joinder so shared utilities and drainage remain enforceable.
After questions about setbacks, minimum lot size for hotels, and whether the split might be driven by future sales or separate lenders, a board member moved to recommend approval of the lot split for applicant Portview Suites LLC at 9009 Astronaut Boulevard; the motion was seconded and the roll call recorded all votes in favor.
The board's recommendation asks the council to approve a resolution that will record the reciprocal easement and require lender consent before the lot split is finalized. That resolution and the council's vote will be necessary for the split to be effective.
