Trustee James Ryan Brown told the code enforcement board that 39 35th Street had been "overrun" by squatters and criminal activity, and that he and his family had been threatened while attempting to regain control of the building.
Brown said he requested an order to vacate and that a warrant for possession was signed by a judge in district court following an eviction. He told the board he planned to ask the sheriffs office to schedule set-outs so the property could be secured and rehabilitated; he estimated the interior damage would require about 60 to 90 days of work and roughly $50,000 to $60,000 to repair.
Alex Gaddis, the attorney representing the Rosebean Kentucky Family Trust, asked the board to stay civil penalties while the eviction and repairs are completed and to set a follow-up inspection to confirm compliance. The presiding officer and board members expressed concern about safety at the site and the scale of liens and fines associated with the property; one board member said the public record shows "about $35,000" in fines and liens.
The board agreed to continue the matter for a status check on April 10 at 8:30 a.m. and advised Brown to coordinate closely with inspector Keel and the sheriffs office for a safe set-out. The chair reiterated the boards enforcement approach: it seeks property compliance first but will collect fines if owners do not follow through.
Next procedural steps: the trustee said his eviction attorney has already filed for set-out with the sheriff; the board will inspect the property on or before April 10 to determine whether the case can be dismissed after documented compliance.
