Board of Equalization votes to have attorney file notice of nonparticipation in four appeals

The Board of Equalization on Feb. 9, 2026, voted to instruct the board attorney to cooperate in the consolidation of four superior-court appeals and to file a notice of nonparticipation on behalf of the board.

The action came after the board recessed into an executive session to receive guidance from its attorney on pending litigation. After returning to the public record, a board member moved “to instruct the board attorney to cooperate in the consolidation for appeals and to file a notice of nonparticipation on behalf of the Board of Equalization” listing four court-case numbers. The motion was seconded and the clerk conducted a roll-call vote; the motion passed on a 5-0 vote.

The board attorney, Scott Brent Erickson, participated in the discussion and told members the questions posed during the disclosure review were sufficient for the board’s purposes. “The questions that you’ve asked are adequate to cover it,” Erickson said on the record before the board took the motion.

Earlier in the meeting two members disclosed prior exposure to media coverage related to the litigation. Board member Mr. Bartos said he had read a NewsMiner article by Jack Barnwell about the Camp Liwa tax-exemption dispute but that it had not changed his view and that he had had no discussions about it. “I need to disclose that I read the NewsMiner article by Jack Barnwell,” he said.

The motion instructing the attorney identified the four superior-court case numbers the board intends the attorney to address: 4FA-26-01126CI, 4FA-26-01127CI, 4FA-26-01128CI and 4FA-26-01129CI. The clerk recorded the roll-call vote as unanimous among those present.

The chair thanked the board attorney for attending and, with no further business, adjourned the meeting at 2:24 p.m.
