Committee passes bill allowing Fulton County to use Atlanta jail when requested by sheriff

Representative Sanchez said Atlanta residents had advocated for closing the jail and repurposing it, and asked why the state should override that process. Representative Adesanya pressed the sponsor on liability: "if an inmate gets injured or somebody gets killed in the city's facility while it's under the county's control, who is liable for that?" The sponsor replied the vehicle for any liability and indemnification would be the intergovernmental agreement negotiated by the parties and advised the city and county attorneys would address indemnity terms.
The bill was tabled at one point after a subcommittee motion, then later removed from the table. When consideration resumed, several members again raised concerns about circumventing the Fulton delegation and about ongoing Department of Justice-related facility issues; the committee ultimately voted to advance the bill.
